ANALISIS PERBEDAAN IMPLEMENTASI KPR KONVENSIONAL DENGAN KPR SYARIAH

Abstract

Penelitian ini bertujuan untuk memahami perbedaan implementasi KPR Konvensional dengan KPR Syariah  jika dilihat dari beberapa aspek, yaitu aspek pola, aspek perhitungan, aspek harga, aspek jaminan, aspek denda dan penalti pada beberapa perbankan di Indonesia. Penelitian ini merupakan penelitian deskriptif dengan pendekatan studi kepustakaan. Dalam penelitian ini penulis juga menyesuaikan implementasi dengan perundang-undangan dan fatwa, bagaimana seharusnya implementasi produk pembiayaan KPR Konvensional dan KPR Syariah. Berdasarkan hasil penelitian ini ditemukan beberapa perbedaan antara implementasi produk pembiayaan KPR Konvensional dengan KPR Syariah dalam 6 aspek, yaitu  aspek pola perbedaan pada jenis akad dan sistem marginnya, aspek perhitungan pada beban tambahan dan besar marginnya, aspek harga pada rumus perhitungan total angsuran pokok ditambah marginnya, aspek jaminan pada prosedur  eksekusi jaminannya,  serta  aspek  denda  dan  penalti  pada  besar prosentase dan perlakuannya.
